Riot Compensation Act

A petition was filed in the High Court of Gujarat for the non implementation of package announced by Government of India for the 2002 riots victims towards casualties, injury and loss to uninsured residential, commercial and industrial properties.

High Court of Gujarat Govt. passed given the judgment in the favour of CSJ and asked State of Gujarat of to release Rs. 300 Crores for the payment of compensation against loss to residential property, which has been distributed to people. The court has further ordered the release and distribution of the funds for the compensation for uninsured commercial properties. The case is still pending for further hearing.

A new aspect was added to the litigation, where issue of illegal demolition of a relief colony for the Internally Displaced Persons n the pretext of the victims being Bangladeshi citizens, was raised before the High Court of Gujarat. The High Court had issued order to provide house and compensation to all the victims except those against whom the order of deportation has been issued by the Government of India. Verification has been completed and the final order is yet to come.

A writ demanding for payment of compensation to the victims of riots whose commercial/residential property have been destroyed and looted by the rioting mobs was filed in the High Court of Gujarat. State Government has agreed to make payment of compensation of Rs. 10,000/- only before the Court. CSJ has to challenge the vires of the existing law on Compensation towards residential or commercial property. The matter is still pending in the High Court.

During the Ramzan Muslim families were harassed by the local political leaders and where threaten. A petition was filled to NHRC to take appropriate action and provide protection to Muslim families.
   
Saputara v/s State- Ongoing case

234 villagers of Navagam village near Saputara were given notice by local government to vacant their village as part of development of Saputara for tourism. Villagers approached the local CSJ unit to seek their support. A petition was filed by CSJ in the High court of Gujarat. The Court has ordered stay and asked the government to provide all the information related to the rehabilitation of villagers and compensation that will be provided to them.
   
Nari Adalat- Women’s Court

CSJ is currently working on establishing 6 further Women’s Courts in 6 different talukas in efforts to expand alternative dispute mechanisms in Gujarat. So far, 30 women who will be part of the new Nari Adalat have being trained by CSJ and awareness about the Nari Adalat was created among 1329 women. 145 women were made swayam sewak for supporting activities of the Nari Adalat. Most recently, in order to set a new work model, two new issues were presented to the group of women; NARI ADALATS and KAMDAR SAHAY KENDRA. They were supported in their work by the Bharuch team to create a proposal and budget on the two new issues. CSj is also aiding them in facilitating the process of Labour support centres.
